EC事業者登録 (電子商取引業者認可・登録)

e-COMMERCE BUSINESS REGISTRATION

オンラインで物品販売、又はサービスの提供をする場合、EC事業者としての商務省認可、及び登録が必要となります。同登録をするに当たって、主に以下が必要となります。

 

ホームページ名

オンラインで売る物品、又はサービス内容の説明

ホームページの運営開始日

取引の決済方法についての説明

インターネットサービスプロバイダー (ISP) からのドメーン登録の証拠

 

同登録は、その事業所が立地する管轄当局が窓口となります。

e-COMMERCE BUSINESS REGISTRATION

Entrepreneurs engaged in the following businesses to apply for e-commerce registration:

  1. The purchase and sale of goods, or provision of services, by electronic media via internet system (e.g. a cosmetics retail sales shop selling its products on Lazada)

  2. Internet service providers (ISPs)

  3. Web-hosting service providers

  4. E-Market Place (Online platform provider, which provides an online marketplace for sellers and buyers of goods or services. E.g. Amazon, Shoppee, Lazada.)

 

(Khun Nat, Is there any clear notification or regulation which exempts certain persons from such e-commerce registration requirements? What about the case where there is an individual who is just selling products from time to time online through Facebook Marketplace. What if this sales goes good and he/she sells a lot every day? What if the person does not have a website? You need to have a website to get a e-commerce certificate. So, will such person be required to make a website?What does it mean to be an “entrepreneur” under this act anyway?)

 

The basis for such registration requirement are:

  • The Commercial Registration Act, B.E. 2499 (A.D. 1956); and,

  • Regulation of Ministry of Commerce on Persons who Have the Duties for Commercial Registration (No. 11), B.E. 2553 (A.D. 2010)

Natural persons and juristic persons engaged in e-Commerce businesses without commercial registration are considered to be in violation of the Business Registration Act, B.E. 2499 (A.D. 1956) and will be subject to fine penalty on a daily basis until such violation is corrected.

 

e-Commerce registration must be completed within 30 days from the date of commencement of business.

 

The following are required to apply for an e-Commerce certificate.

  • A website which is ready or is already online

  • Website name

  • Description of the goods or services being sold on the website.

  • Start date on which the website began operating.

  • Method of ordering for goods or services

  • Method of payment for customer purchases (It may be online payments, e.g. by credit card, through the website or offline e.g. via bank transfer.)

  • Specification about the method of delivery. (e.g. by EMS, courier, by downloading, etc.)            

  • Evidence of the domain name registration from the service provider internet service provider (ISP).

 

After successful application and approval, the applicant will receive an e-Commerce Certificate (Form Phor Khor. 0403).

Subsequently a source code will be sent from the Department of Business Development (DBD) of the Ministry of Commerce, to the applicant. The source code is an HTML tag which links to a page on a website operated by the DBD (www.trustmarkthai.com) showing the applicants registration details. The link must be presented on the website of the applicant.

  • Complete an E-Commerce license application and other forms, with the assistance of the client.

  • Filing the application with the District office.

  • Assist in communicating with the District office.

  • Accompanying the representatives of the client in meetings with the District office if necessary.

  • Follow up the application with the District office.

  • Submit any additional information or documents required by the District office with the assistance of the client.

  • Receive the E-Commerce license.

  • Provide an English translation of the E-Commerce license.

  • Correspondence by email, telephone and in person meetings when necessary.

 

The total process can take up to 1 month or more to complete.
